Terms of Service

Welcome to EnviroGreen Duct Cleaning (“Company,” “we,” “our,” or “us”). By accessing or using our services, including making payments online, you (“customer,” “you,” or “property owner”) agree to the following Terms of Service. Please read these terms carefully before using our services.

1. Acceptance of Terms

By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, along with our Privacy Policy. If you do not agree to these terms, please do not use our services.

2. Services Provided

EnviroGreen Duct Cleaning offers professional duct cleaning services aimed at improving indoor air quality and HVAC system efficiency. All services will be performed in accordance with industry standards and best practices.

3. Payment Terms

• Payment Methods: We accept various forms of payment, including credit/debit cards and online payment platforms.

• Payment Due Date: Payment is due upon completion of the services unless otherwise agreed upon in writing.

• Late Payments: Late payments may incur additional fees.

4. Online Payments

By making a payment online, you agree to these Terms of Service. All online payments are final. In the event of a dispute, our liability is strictly limited to the fees paid for the services rendered.

5. Refunds and Returns

You agree to process returns and provide refunds and adjustments for your goods or services through your account in accordance with these terms and any applicable Card Association Rules. Card Association Rules may require that you:

• Maintain a fair return, cancellation, or adjustment policy.

• Disclose your return or cancellation policy to customers at the time of purchase.

• Not give cash refunds to a customer in connection with a Card sale, unless required by law.

• Not accept cash or any other item of value for preparing a Card sale refund.

The amount of the refund/adjustment must include any associated taxes required to be refunded and all Payment Processing Fees and cannot exceed the amount shown as the total on the original sales data except by the exact amount required to reimburse the customer for postage that the customer paid to return merchandise. If you accept returns and are making an uneven exchange of merchandise (e.g., the sales price is not the same), you must issue a credit for the total amount of the merchandise being returned and complete a new sale for any new merchandise. Please be aware, if your refund policy prohibits returns or is unsatisfactory to the buyer, you may still receive a Chargeback relating to such sales. You can process a refund through your account up to sixty (60) days from the day you accepted the payment. Because you are responsible for all Payment Processing Fees, in the event of a refund, we may retain the Payment Processing Fees previously paid for the transaction; however, you are responsible for refunding to your customer the full amount paid by your customer (including the Payment Processing Fees), and you authorize us to refund all such amounts to the consumer from your account. We have no obligation to accept any returns of any of your goods or services on your behalf.

6. Limitation of Liability

Our liability is limited solely to the amount paid for the services under the agreement. We are not responsible for incidental, indirect, or consequential damages.

7. Disclaimers and Waivers

General Disclaimer

• All materials are guaranteed to be as specified.

• All work will be completed correctly as determined by the contractor and standard industry procedures.

• Any alterations from the specified work will be executed only upon written orders from the property owner and will incur extra charges.

• Our workers are fully covered by workers’ compensation insurance.

• No verbal statements, promises, or opinions of our representatives shall be binding unless specifically noted on the work order.

• The property owner assumes all responsibility for damages due to the breakage of any hidden fuel/utility service line, though we will do our best to avoid such damage.

• EnviroGreen Duct Cleaning accepts no liability for conditions existing prior to cleaning, nor will we be responsible for any damage to outdated or neglected components of the HVAC system to be cleaned or the re-contamination by any uncleaned component as requested by the customer.

• During the process of removing and reinstalling vent covers, there is a potential for paint chipping. Technicians will be as careful as possible, but the responsibility for paint touch-up and/or repair shall be assumed by the customer.

Microbial Contamination Disclaimer

If applicable, in the instance of visible microbial contamination on the HVAC ductwork and/or system components, the property owner hereby classifies this project as cleaning and agrees this project does not fall under New York State Department of Labor Article 32 of the labor law or any other such laws or regulations.

Remediation Work Disclaimer

The property owner is responsible for informing the contractor of the presence of asbestos. If applicable, this site-specific Mold Remediation Work Plan is prepared based on the property owner’s assessment. Unless otherwise indicated, the property owner assumes the role of Assessor for the Remediation Plan and post-cleaning clearance and hereby accepts and agrees to the Mold Remediation Work Plan and agrees this project does not fall under New York State Department of Labor Article 32 of the labor law or any other such laws or regulations.

8. Notice of Cancellation

If you choose to proceed with this scope of work, you may cancel this transaction, without penalty or obligation, within three business days from the original date of the contract. If you cancel, any property traded in, any payment made by you under the contract sale, and any negotiable instrument executed by you will be returned within thirty business days following the receipt by the seller of your cancellation notice, and any security interest arising out of the transaction will be canceled. If you cancel, you must make available to the seller at your residence, in substantially good condition as when received, any goods delivered to you under this contract or sale; or you may, if you wish, comply with the instructions of the seller regarding the return shipment of the goods at the seller’s expense and risk. If you do make the goods available to the seller and the seller does not pick them up within twenty days of the date of cancellation, you may retain or dispose of the goods without any further obligation. If you fail to make the goods available to the seller, or if you agree to return the goods to the seller and fail to do so, then you remain liable for the performance of all obligations under the contract.

9. Mechanic’s Lien Notice

Any contractor, subcontractor, or material supplier who provides home improvement goods or services pursuant to your home improvement contract and who is not paid may have a valid legal claim against your property known as a
